TSD e-Service

• “User” means a TSD e-Service user.
• “Personal Data” means data related to a person which enables such person to be identified whether directly or indirectly, excluding data of a deceased person in particular, pursuant to the laws on personal data protection.
• “Process” means any operation performed on Personal Data, whether or not by automated means, such as collection, recording, systematization, storage, modification or adaptation, recall, consultation, use, disclosure (by transmitting, transferring, dissemination or making accessible or available by any mean), arrangement, consolidation, blocking or restriction, erasure or destruction.
• “SET Group” means the Stock Exchange of Thailand and/or the Companies in SET Group.
• “Companies in SET Group” mean companies established by the Stock Exchange of Thailand or the subsidiaries of the Stock Exchange of Thailand, in which the Stock Exchange of Thailand holds at least 50 (fifty) percent of such company’s registered capital, whether directly or indirectly.
• “TSD” means Thailand Securities Depository Co., Ltd.

The User acknowledges and agrees that TSD e-Service is a service rendered by TSD to an investor, including facilitating investor in inspecting and editing data specifically to a person by himself/herself through internet network and/or accessing any news under the scope of services stipulated by TSD. Examples of provided services include registered securities holder data, balance of securities holding data, scrip data, statement of securities holding in issuer account, sent out and returned documents, withholding tax certificates report, etc. In the future, TSD may provide additional services, such as data collection, data storage, exercise of rights by a securities holder, securities transaction, and etc. Thus, by accessing any services under TSD e-Service, it shall be deemed that the User agrees and consents to comply with the Terms and Conditions for Use of TSD e-Service and any specific terms and conditions of use (if any) of such services under TSD e-Service.

1. The User acknowledges and agrees to comply with the Terms and Conditions for Use of TSD e-Service and/or any other conditions and stipulations prescribed or amended by TSD in the future. The User also agrees to fully comply with all relevant laws and regulations.
2. The User acknowledges and agrees that an amendment to any data of the User through TSD e-Service shall result in an amendment of User’s data as appeared in the securities holder’s registration and the amended data shall be considered an up-to-date data as appeared in the securities holder’s registration unless the User amends it further through other channels later.
3. The User acknowledges and understands that TSD e-Service may be linked to the services or work system of other persons such as the work system of the Revenue Department to facilitate the User. However, the link to others’ service or work system does not mean that others’ service or work system are under the control or responsibility of TSD. Therefore, the User has a duty to additionally study the terms and conditions for use of such linked others’ work system. In addition, TSD cannot warrant the correctness, credibility or safety of the linked others’ work system and shall not be liable for any loss or damage sustained by the User in relation to linked others’ work system. In this regard, if the User makes any transactions or has any operations through the services or channels of TSD e-Service to link with such others’ work system, the User shall agree to comply with the conditions as stipulated by TSD for such transactions or operations.
4. The User may suspend or cancel the User’s use of any service on his/her own via website and/or application (collectively “Platform”) as provided by SET Group for such proceedings in accordance with the procedures and methods stipulated by TSD.

1. The User acknowledges and agrees that the User shall access the services by entering his/her own username and password or any other methods as stipulated by TSD having security measure comparable to those of accessing the services by entering username and password (collectively “Access Code”) for using TSD e-Service.
2. The User acknowledges and agrees that if the User enters an incorrect username and/or password more than 3 times, the User shall not be able to access TSD e-Service. If the User wishes to continue accessing TSD e-Service, the User shall use the forgetting password function by himself/herself via TSD e-Service Platform in accordance with the stipulated procedures and methods.
3. The User acknowledges and agrees that the password is confidential data and must be kept confidentially by the User. The User can change password at any time by himself/herself without having to notify TSD.
4. The User acknowledges that TSD may stipulate additional conditions for access to TSD e-Service by any other methods in the future. It shall be deemed that the User who wishes to access TSD e-Service by such other methods agrees to comply with additional conditions as stipulated by TSD and that the additional conditions are deemed a part of the Terms and Conditions for Use of TSD e-Service.
5. The User acknowledges and agrees that the act of accessing TSD e-Service and making any transactions resulting from login by Access Code in any cases shall be deemed correct and complete and deemed the User’s own act, and the User agrees to be responsible for all the actions resulted from such acts. In addition, in the event of any damage arising from any cause whatsoever, the User agrees to refrain from raising any disputes or any claims against TSD to be liable for damages on behalf of and/or to the User in any cases whatsoever.

• In relation to Personal Data, for the service to be successfully linked to other services in accordance with the wish of User, TSD has a necessity to disclose and/or deliver Personal Data of the User, such as data on access to TSD e-Service, data in relation to identification and authentication, etc., to SET Group that the User wish to access the service.
• In relation to data other than Personal Data, TSD may disclose and/or deliver data other than Personal Data of the User to SET Group as deemed appropriate.

1. TSD bears no liability whatsoever for any damage incurred by the User from the use of TSD e-Service in any case whatsoever.
2. In the event that the disruption of computer system of TSD or the communication system results in inability of the User to use TSD e-Service, the User agrees to refrain from raising such disruption as a claim to hold TSD liable.
3. In the event that TSD suffers any damage resulting from the User’s use of TSD e-Service, the User agrees to be fully and unconditionally liable for compensation for damage suffered by TSD.
4. TSD may amend the Terms and Conditions for Use of TSD e-Service and/or cancel TSD e-Service at any time without having to notify the User in advance and explain the reason for such amendment and/or cancellation of TSD e-Service.

The User may suspend or cancel the use of TSD e-Service by himself/herself via TSD e-Service Platform in accordance with procedures and methods as stipulated.

The terms and conditions for using this service shall be governed and interpreted under the laws of Thailand. Thai court shall have the jurisdiction over disputes which might arise under the terms and conditions for using this service.

The User acknowledges and agrees that the User’s Personal Data provided to TSD, including the data concerning the access and use of TSD e-Service and other TSD’s services that are linked to TSD e-Service, shall be Processed and protected in accordance with the Privacy Notice of SET Group of which the details and stipulations have been read and acknowledged by the User.
